Agreement to Terms

By accessing or using StonedGPT ("we", "our", or "us") at this website (the "Site"), you agree to be bound by these Terms of Use. If you disagree with any part of these terms, you do not have permission to access the Site or use our services.

Account Registration and Security

To access certain features of the Site, you may be required to register for an account. You agree to provide accurate, current, and complete information during registration and to update such information to keep it accurate, current, and complete. You are responsible for safeguarding your account credentials and for any activities or actions under your account.

Service Terms and Rate Limits

We offer both free and paid service plans with different usage limits. Free users have daily limits on text and image generations, while paid subscribers receive higher limits and priority access. Usage limits reset every 24 hours. Paid services are billed according to the terms specified at the time of purchase through Stripe. You can cancel your subscription at any time, but refunds are subject to our refund policy. We reserve the right to modify, terminate, or otherwise amend our offered services and pricing.

Acceptable Use

You agree not to use the Site or its content for any unlawful purpose or in any way that could damage, disable, overburden, or impair our services. Our AI models are designed for creative and educational purposes only. Specifically, you agree not to:

  • Use automated methods or scripts to access, scrape, or collect information from the Site
  • Engage in spamming, harassment, or other abusive behavior
  • Share your account credentials or subscription access with others
  • Attempt to bypass any access restrictions, rate limits, or security measures
  • Use our services to violate any applicable laws or regulations
  • Upload or transmit viruses, malware, or other harmful code
  • Generate content that is illegal, harmful, harassing, defamatory, or violates others' rights
  • Attempt to generate content that violates our content moderation policies
  • Use the service to create misleading, fraudulent, or deceptive content

Intellectual Property

The Site and its original content, features, and functionality are owned by StonedGPT and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws. You may not copy, modify, create derivative works of, publicly display, publicly perform, republish, or transmit any of the material on our Site without prior written consent.

User Content and AI-Generated Content

You may submit prompts, images, and other content to generate AI responses. You retain ownership of your input content but grant us a license to use, store, and process it as necessary to provide our services. All AI-generated content (text and images) is owned by StonedGPT, but you are granted a non-exclusive, royalty-free license to use such generated content for your personal and commercial purposes. You agree to:

  • Only submit content that you own or have permission to use
  • Respect all applicable privacy laws and regulations
  • Not submit content that is illegal, harmful, or violates others' rights
  • Not attempt to reverse engineer or extract proprietary information from our service
  • Understand that conversations may be stored for up to 30 days for service provision and then automatically deleted
  • Accept that content is subject to automated moderation systems

AI Content Disclaimer and Limitation of Liability

Our AI models are powered by third-party services (DeepSeek for text, OpenAI for images) and may generate inaccurate, inappropriate, or unexpected content. We implement content moderation but cannot guarantee all generated content will be suitable for your purposes. StonedGPT shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from your use of or inability to use the Site, including but not limited to damages arising from AI-generated content. We provide our services "as is" and do not guarantee the accuracy, completeness, reliability, or availability of our services or AI-generated content. Your use of our services is at your own risk.

Termination

We reserve the right to terminate or suspend your account and access to our services immediately, without prior notice or liability, for any reason, including breach of these Terms. Upon termination, your right to use the Site will immediately cease.

Changes to Terms

We reserve the right to modify these terms at any time. We will notify users of any material changes by posting the new Terms of Use on this page and updating the "Last Updated" date at the top of this page. Your continued use of the Site after any such changes constitutes your acceptance of the new Terms of Use.
